These SMS Terms and Conditions govern text messages sent by Fink Caps LLC (“Fink Caps,” “we,” “us,” or “our”). By voluntarily opting in to one of our SMS programs, you agree to these terms.
SMS PROGRAM DESCRIPTION
Fink Caps operates SMS programs for two distinct purposes:
Transactional and customer-service messages related to an inquiry, account, order, or requested service. These messages may include inquiry follow-ups, order confirmations, shipping or delivery updates, appointment reminders, and account notifications.
Marketing and promotional messages that may include product news, announcements, discounts, special offers, and other promotional updates from Fink Caps.
Users choose separately whether to receive each message category. Consent to transactional messages does not constitute consent to marketing messages, and consent to marketing messages does not constitute consent to transactional messages.
HOW TO OPT IN
You may opt in by entering your mobile telephone number on our SMS opt-in page and voluntarily selecting the unchecked consent box corresponding to the type of messages you want to receive: https://finkcaps.com/opt-in
Each consent checkbox is optional and is not preselected. You must actively select a checkbox before submitting the form. Consent to receive SMS messages is not a condition of purchasing any goods or services.
By opting in, you confirm that:
You are the owner or authorized user of the telephone number provided.
You are at least 18 years old.
You authorize Fink Caps LLC to send text messages to that number for the category you selected.
The consent information you provide is accurate and complete.
MESSAGE FREQUENCY AND CHARGES
Message frequency varies based on the message category selected and your interactions with Fink Caps. Message and data rates may apply. Contact your wireless carrier for information about your text or data plan.
OPTING OUT
You may revoke your consent and opt out at any time by replying STOP to any SMS message from Fink Caps.
After opting out, you may receive one final message confirming that your request was processed. You will receive no further SMS messages for the applicable program unless you voluntarily opt in again.
We may also recognize other clear opt-out requests when required by applicable law.

CARRIER DISCLAIMER
Wireless carriers are not liable for delayed, undelivered, or misdirected messages. Message delivery is subject to effective transmission by your wireless carrier and is not guaranteed by Fink Caps.
SUPPORTED CARRIERS AND DEVICES
Participation requires a text-message-capable mobile device and service from a participating wireless carrier. The SMS program may not be available through every carrier or on every device.
PRIVACY AND DATA SHARING
Your privacy is important to us. Information collected through our SMS programs is handled according to our Privacy Policy:
No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Information may be shared with service providers or subcontractors that support services such as customer service or message delivery. All other use-case categories exclude text-messaging originator opt-in data and consent; this information will not be shared with third parties.
PROHIBITED USE
You may not use our SMS program for unlawful, abusive, fraudulent, or unauthorized purposes or interfere with the operation of the program.
CHANGES TO THESE TERMS
We may update these SMS Terms and Conditions to reflect changes to our messaging services, business practices, or legal obligations. Updates will be posted on this page with a revised “Last updated” date. Your continued participation after an update becomes effective constitutes acceptance of the updated terms.
TERMINATION
We may suspend or discontinue an SMS program, or your participation in it, when reasonably necessary. Ending a program does not affect rights or obligations that arose before termination.
